Every country has a standard procedure, where the proceedings of the crime are conducted in the court of law and the judge makes a decision based on the hearing. Some people believe that these procedures can be standardized by fixing punishment for each type of crime. Others, believe that this will be impossible to implement and decision on the punishment should only be decided after considering the circumstances and motivation for committing it.
One one side, fixing standard punishment for every crime will cut down on proceeding time and substantially expedite the process. This will particularly be helpful in countries like India, where the case proceedings take several years and may even stretch to decades. This will also set clear standards, where every criminal before committing the crime will be well aware of its consequences.
However, these process and regulations may not be practical to implement as ever crime needs a careful judgment. Crime is a serious issue and cannot be subject to standard rules. Many crimes are committed in self defense cannot be treated same as a brutal murder. This necessitates the proper proceedings where the circumstances and the motive of the crime should be carefully studies and understood. Also, setting standard punishment can provoke severity and brutality in crime. For example, suppose a standard punishment for a murder is set at a lifetime sentence. Criminal may be provoked to commit several murders, assured by the fact that the maximum punishment he/she will be subject to is a lifetime sentence.
To recapitulate, standardizing the proceeding would obviously expedite the process and send out a clear message of consequence of every crime. However, crime is an serious issue , particularly because human lives are involved and hence requires careful and judicious judgment before the decision is made.
