Some people believe that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motivation for committing it, should always be taken into account when deciding on the punishment. Discuss both these views and give your own opinion.
Nowadays, the number of committed crimes in society is on the increase and it becomes a serious problem for government authorities. Although there are fixed punishments for the crimes and criminals are aware of the consequences, the crime figures show a dramatic increase in recent years. It is believed by a group of people that fixed punishments should be replaced by more flexible punishments, this will be discussed below.
There are some persuasive arguments in favor of having fixed punishment for each type of crime. Firstly, it seems to be a deterring parameter for offenders who decide to commit a crime since they are aware of the consequences. Secondly, the justice system would be much fair and decisions would not be based on the judges' attitudes toward the problem and judging would be much easier. Finally, making awareness in society would bring excessive knowledge for the younger fellows and may prevent them from vandalism, juvenile delinquency, smuggling, rubbery and the like. Furthermore, serious crimes would be distinguished easily from petty crimes.
On the other hand, there are some strong arguments against fixed penalties and a group of people believe that the motivation for committing a crime should be taken into account. The most important impact of such a decision would be on the judicial system since judges can make decisions by analyzing the situation in which the crime is committed. Take a thief for example, who rubbed some loaf of breads with the aim of feeding his family. The penalty should be far different with punishment of a person who does rubbery as a job and with the purpose of making benefits.
To sum up, although fixed punishment is beneficial in order to make awareness among people and reveals the results of committing a crime for criminals, the more flexible penalties seems to be more fair and will lead to better judicial system.
